TIER1GRAPHIX Terms & Conditions

The following terms and conditions apply to all design and associated services offered by TIER1GRAPHIX. By entering a project with TIER1GRAPHIX you are consenting to be bound by these terms, policies, and procedures that are standard in the industry and also in accordance with the Code of Ethics established by the Graphic Artists Guild. TIER1GRAPHIX may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective as of 01/07/22; thus all estimates/proposals will direct clients to this web page to inform them of TIER1GRAPHIX policies. Failing to read this page is not an acceptable excuse for not abiding by these policies. A formal contract along with the invoice will be sent and signed by both parties before work is started.

Originality

Unlike those generic sites that create generic computerized graphics; at TIER1GRAPHIX, we are a group of unique minds with capable skills that equates to originality. No design done for a client will ever be duplicated for another client. You can expect original designs for every project.

Graphic designs created at our studio are custom and exclusive to each business, so the designs are yours after final payment has been made. Any concepts that are not chosen and paid for will be a violation of TIER1GRAPHIX's rights if they are used elsewhere.

Copyright Responsibility

TIER1GRAPHIX creates custom graphic design projects based on the information provided by clients. It is the sole responsibility of the client to ensure that any intellectual property (artworks, photographs, fonts, ideas, etc.) the client provides is owned by them in accordance with copyright laws. TIER1GRAPHIX cannot be held responsible for any copyright violations, legal actions, or resulting fees due to items provided by the client.

 

Likewise, the client is responsible for completing such things as fictitious name searches prior to assigning logo designs.

Furthermore, TIER1GRAPHIX is not liable for any designs that are not legally approved (Copyright, Trademark, FDA, etc). The submission of approval for all designs is the responsibility of the client.

Proofreading or Revisions

All our designs come with the option of unlimited revisions and limited revisions (a set number of complimentary changes). Once complimentary changes are exhausted, all further changes are billed at our hourly rate ($10 USD per hr). In addition, once a design has been approved, we consider the project closed. Any further changes to a design after it has been approved will be billed at our hourly rate. 

 

In this industry, changes made by the client are referred to as Author's Alterations (aka AA's). These include when the client modifies their original copy, project direction or scope, photograph/artwork, or other elements of the original assignment. The client shall be responsible for making additional payments for changes requested that do not conform to the original assignment. As the designer and originator, TIER1GRAPHIX shall be offered the first opportunity to make any modifications or changes.

 

If TIERGRAPHIX was to make a mistake (spelling, grammatical, etc.) it will be corrected at no charge. TIER1GRAPHIX may also make minor revisions at no charge. 

Revisions are provided in order to make your design perfect, and should not be used to create additional designs separate from the one paid for.

Credit

TIER1GRAPHIX reserve the right to publish/showcase all completed projects created for a client to our portfolio and website; and a website credit to the footer of your website.

 

Notwithstanding, we are open to signing a Non-Disclosure Agreement (NDA) provided by the client in a case where their content is reasonably confidential, which is binding for no longer than twelve (12) months. If there is a privacy issue involved, please inform us.

Currency

All prices listed on our website are in USD (American) or JMD (Jamaican) dollars. If you are not located in the United States of America and want to know how much it would convert to in your currency, you can check out the conversion with Google’s Currency Converter.

Payment and Refund

You can make cancellations at any time; however, for payments that have been made to TIER1GRAPHIX, we are only open to delivering a full refund if work has not yet started on a project. However, once work has begun, funds already paid over are non-refundable.

A 50% non-refundable deposit is due before work can commence. In the case where a 50% deposit is made and a refund is requested before the project's completion, the 50% deposit is non-refundable. However, the client will not be required to pay the remaining 50% as the project would not have been completed.

The balance of the 50% is to be paid at the end of the project, once the project is approved and before the final package is delivered. A deposit invoice is emailed to you at the start of the project.

We offer payment plans for the following services, website design.

Payment Methods

- Bank Transfer

- Wire Transfer (Western Union or Moneygram)
- PAYPAL or CASHAPP (USD only)

- LYNK

 

We do not accept cash or cheques at the moment.

 

We quote in USD, but our exchange rate is US$1:JM$150 for Bank and Wire Transfers.

Working Hours

As it relates to deliverables and time; TIER1GRAPHIX is only liable to deliver a design within the confines of our business hours (Monday to Saturday, 9am - 5pm). They do not include Sundays or holidays unless otherwise stated.

You can expect a response to emails within 24-48 hours, where a response is not provided immediately. All communication will also be done within our work hours of Monday to Saturday, 9am - 5pm.

Abandon Projects

Each project has a timeline and an estimated start and completion date. Please respect our timeline and respond in a timely fashion with any revision requests once the project has commenced.

 

A project will be considered abandoned if I have not heard from you in 30 days. You will not have any rights to use any of the work that was presented to you during the process; unless the project has been paid in full. If I have not heard from you and you contact me after the 30-day abandonment, a start-up fee may apply.
